How to get custody of grandchild after daughter death. Need help with Kentucky's Grandparent Law Please?

Feb 8th 2011, my niece Adrienne White died from injuries after being struck by a car in Louisville, Ky. She was only 16 and left behind a two years old baby; the father is unknown. My sister is having a hard time getting full custody of her grandson. The court order her ( my niece) father-Charles Bell full custody which he just been release from prison three years ago after serving 13 years. He been in prison most of her life and have a long violet criminal history. Two weeks prior to her death - he hit her with a close fist and was not able to see her or the baby. The day she died, he got the baby and now will not allow my sister to visit or talk to the baby. He went to court before her and was give custody. My sister show the court his criminal history but was pushed away. She have a lawyer who isn't worth a damn. I need help! This is a shock to me! What can I do to help my sister get custody or half custody? What are her rights in Kentucky? Please direct me in the right direction.
